Terms of Service

These Terms of Service govern access to and use of TalesNTokens. They incorporate the Privacy Policy, Cookie Policy, Acceptable Use Policy, Community Guidelines, Copyright and DMCA Policy, Marketplace Terms, Creator Agreement, Refund Policy, Security Policy, and Trust and Safety Policy.

Definitions

"Platform" means TalesNTokens websites, apps, APIs, game rooms, sandbox tools, map builder, marketplace, creator tools, WebSocket services, storage, and bridge features.

"User" means any person who visits, creates an account, joins a room, uploads content, buys content, sells content, or uses the sandbox.

"Creator" means a user who uploads or lists assets for distribution or sale.

"Buyer" means a user who obtains digital content through the marketplace.

"User Content" means maps, tokens, character sheets, notes, chat, uploads, rooms, listings, creator assets, and other content submitted by users.

"Digital Content" means downloadable, streamable, unlockable, or platform-accessible maps, tokens, art, packs, templates, rules data, or similar digital goods.

Scope

These Terms apply to all use of the Platform. Additional terms apply to marketplace transactions, creator uploads, refunds, reporting, moderation, security, and copyright matters.

Eligibility

Users must be at least 13 years old. Users under 18 may use the Platform only with consent and supervision from a parent or guardian. Users must not use the Platform if they are prohibited by law, sanctions, payment rules, or prior enforcement action.

The Platform is not designed for children under 13 and must not be used to collect or share personal data about children unless expressly permitted by law and platform rules.

Account Access

TalesNTokens currently uses Supabase magic-link authentication and invite-code access controls. Users are responsible for keeping email accounts and sessions secure. Users must not share accounts, sell accounts, bypass access controls, impersonate others, or use another person's account without permission.

User Content And Platform Licence

Users retain ownership of User Content.

Users grant TalesNTokens a limited, worldwide, non-exclusive, royalty-free licence solely to:

• host User Content;
• display User Content to the user and to other users selected through platform functionality;
• process User Content for gameplay, editing, search, previews, moderation, safety, support, and marketplace fulfilment;
• create technical backups and disaster-recovery copies;
• share User Content within rooms, private links, public listings, marketplace purchases, or other platform features selected by the user.

This licence is only for operating, securing, improving, and enforcing the Platform. TalesNTokens does not claim ownership of user-created maps, tokens, character sheets, notes, uploaded assets, creator packs, or marketplace content.

Users must have all rights necessary to upload, share, sell, or licence their User Content. Users must not upload pirated content, stolen assets, malware, unlawful content, or content that violates another person's rights.

Public And Private Rooms

Room privacy depends on room settings, membership, links, assigned players, and access controls. Users are responsible for choosing appropriate sharing settings. TalesNTokens may restrict or remove access to rooms that violate these Terms, the Acceptable Use Policy, or law.

Marketplace Terms

Marketplace purchases, creator uploads, revenue share, refunds, chargebacks, licence categories, takedowns, commercial use, personal use, redistribution restrictions, and copyright disputes are governed by the Marketplace Terms and Creator Agreement.

Payments

Payments are processed by Stripe. Users must provide accurate billing information and must not use unauthorized payment methods. Taxes, fees, refunds, failed payments, chargebacks, and disputed transactions are governed by the Refund Policy, Marketplace Terms, and Stripe rules.

Digital Content And Consumer Rights

Digital Content is provided under the licence shown at checkout or on the listing. Nothing in these Terms limits statutory rights that cannot be limited under UK or EU consumer law, including rights relating to faulty digital content.

Where the law permits, digital content access may begin immediately after purchase only after the user expressly requests immediate access and acknowledges any effect on statutory cancellation rights. Faulty content, misdescribed content, duplicate charges, failed delivery, and unauthorized charges are handled under the Refund Policy.

Acceptable Use

Users must comply with the Acceptable Use Policy, Community Guidelines, Child Safety Policy, User Reporting Policy, and Trust and Safety Policy. Prohibited conduct includes harassment, hate speech, illegal content, malware, fraud, pirated content, stolen assets, account abuse, exploits, automation abuse, marketplace scams, and attempts to bypass moderation or security.

Safety, Moderation, And Enforcement

TalesNTokens may review, restrict, remove, demonetise, delist, quarantine, or preserve content where necessary to enforce these Terms, protect users, respond to reports, comply with law, or prevent harm. Enforcement may include warnings, feature limits, marketplace holds, account suspension, account termination, referral to payment providers, or referral to lawful authorities.

Moderation and appeal procedures are described in the Content Moderation Policy.

Copyright

Copyright notices, takedowns, counter-notices, repeat infringer rules, marketplace copyright disputes, and asset restoration requests are handled under the Copyright and DMCA Policy.

Security

Users must not probe, scan, exploit, overload, scrape, automate, reverse engineer, or interfere with the Platform except as expressly permitted by the Security Policy. Vulnerabilities should be reported to security@talesntokens.com.

Availability And Changes

The Platform may change, pause, restrict, or discontinue features. We aim to provide reliable service, but we do not guarantee uninterrupted access. We may update these Terms. Material changes will be announced through the Platform, email, or another reasonable method.

Disclaimers

The Platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law. TalesNTokens does not guarantee that user-generated rooms, uploads, marketplace assets, or third-party integrations will be error-free, uninterrupted, lawful in every jurisdiction, or suitable for every game or use case.

Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or statutory consumer rights that cannot be waived.

To the fullest extent permitted by law, TalesNTokens is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits; loss of goodwill; loss of data caused by user action or third-party services; or disputes between users, creators, buyers, game masters, players, or external platforms.

For paid services, TalesNTokens' total liability for claims arising from a transaction is limited to the greater of the amount paid by the user for the relevant service in the 12 months before the claim or GBP 100, except where law requires otherwise.

User Obligations

Users must:

• comply with these Terms and all incorporated policies;
• provide accurate account, creator, payment, tax, and support information;
• use the Platform lawfully and respectfully;
• keep accounts secure;
• respect content ownership and licence restrictions;
• report safety, copyright, marketplace, and security issues through the relevant channels;
• cooperate with reasonable investigations.

Platform Obligations

TalesNTokens will:

• provide the Platform with reasonable skill and care;
• honour users' ownership of User Content;
• apply policies in a proportionate and consistent way;
• provide contact and appeal routes where required;
• maintain appropriate security, privacy, retention, and reporting processes;
• respect statutory consumer rights.

Enforcement Procedures

We may enforce these Terms by warning users, limiting features, removing content, suspending accounts, terminating accounts, withholding marketplace payouts, cancelling transactions, issuing refunds, preserving evidence, notifying payment providers, or notifying authorities where legally required or appropriate.

Appeals Process

Users may appeal enforcement decisions within 30 days by following the instructions in the decision notice or contacting appeals@talesntokens.com. Appeals should include the account email, content or transaction ID, the decision being appealed, and supporting information. Appeals are reviewed by someone not solely responsible for the original decision where reasonably practicable.

Governing Law

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws of another jurisdiction apply. Courts of England and Wales have jurisdiction, subject to mandatory consumer rights.
