Copyright and DMCA Policy

This policy explains how TalesNTokens handles copyright, DMCA-style notices, counter-notices, repeat infringers, marketplace rights disputes, and takedowns. It should be read with the Terms of Service, Marketplace Terms, Creator Agreement, and User Reporting Policy.
Definitions
"Copyright Notice" means a report alleging that content on TalesNTokens infringes copyright or related rights.
"Counter-Notice" means a response from the user whose content was removed or disabled.
"Rights Holder" means a person or entity that owns or is authorised to enforce copyright or related rights.
"Reported Content" means content identified in a Copyright Notice.
Scope
This policy applies to user-generated maps, tokens, images, character sheets, notes, uploaded files, marketplace Assets, creator listings, previews, bridge snapshots, public pages, and other content hosted or displayed by TalesNTokens.
User Content Ownership
Users retain ownership of their own content. TalesNTokens does not claim ownership of user-created content. Users must not upload, sell, publish, or share content they do not own or have permission to use.
Copyright Notice Requirements
To report alleged infringement, email copyright@talesntokens.com with:
- the Rights Holder's legal name and contact details;
- identification of the copyrighted work claimed to be infringed;
- the URL, room ID, listing ID, asset ID, or other information sufficient to locate the Reported Content;
- a statement that the Rights Holder has a good-faith belief the use is not authorised by the owner, agent, or law;
- a statement that the information in the notice is accurate and, under penalty of perjury where applicable, that the sender is authorised to act for the Rights Holder;
- a physical or electronic signature.
Incomplete notices may delay review.
DMCA Designated Agent
Copyright notices should be sent to copyright@talesntokens.com.
If TalesNTokens relies on United States DMCA safe harbour protections, it must maintain and publish a registered DMCA designated agent with the U.S. Copyright Office. This registration and public agent record must be completed before launch if the Platform intends to claim DMCA safe harbour.
Takedown Procedure
After receiving a valid notice, TalesNTokens may:
- remove or disable access to Reported Content;
- notify the uploader or Creator;
- suspend sales or downloads;
- preserve records for disputes;
- withhold affected payouts;
- issue refunds where required;
- reject repeat or abusive notices.
TalesNTokens may remove content without a formal notice where it independently identifies infringement, stolen assets, pirated content, or other policy violations.
Counter-Notice Procedure
If content is removed and the uploader believes the removal was mistaken or authorised, the uploader may email copyright@talesntokens.com with:
- account email and contact details;
- identification of removed content and previous location;
- a statement under penalty of perjury where applicable that the removal was due to mistake or misidentification;
- consent to applicable jurisdiction where required by law;
- a physical or electronic signature;
- supporting evidence of ownership, licence, public-domain status, fair use/fair dealing, or other authorisation.
TalesNTokens may forward the Counter-Notice to the original claimant. Content may be restored where legally appropriate, unless the claimant starts legal proceedings or TalesNTokens determines restoration would create unacceptable legal or safety risk.
Repeat Infringer Policy
TalesNTokens may suspend or terminate users who repeatedly infringe copyright or repeatedly upload stolen assets. The platform may consider the number, severity, timing, validity, and outcome of notices and counter-notices.
Marketplace Copyright Disputes
For Marketplace Assets, TalesNTokens may:
- delist the Asset;
- disable downloads;
- suspend sales;
- preserve buyer licence records;
- hold or reverse payouts;
- require proof of ownership;
- notify affected Buyers;
- issue refunds or replacement access where appropriate.
False Or Abusive Notices
Submitting false, misleading, abusive, or bad-faith copyright notices or counter-notices may lead to account restrictions, liability, and referral to legal authorities.
User Obligations
Users must upload only content they own, created, licensed, or are legally allowed to use. Users must keep licence records for marketplace assets and cooperate with copyright investigations.
Platform Obligations
TalesNTokens will provide a notice process, respond reasonably to valid notices, notify affected users where appropriate, preserve appeal routes, enforce repeat infringer rules, and avoid claiming ownership of user-created content.

Enforcement Procedures
Enforcement may include removal, disabling, delisting, payout holds, refunding buyers, account suspension, account termination, repeat infringer classification, and legal referral.
Appeals Process
Users may appeal copyright enforcement through a Counter-Notice or by emailing appeals@talesntokens.com within 30 days. Appeals should include evidence of rights or authorisation.
